Chapter 03: Interrelation with Other Exemptions

3.1 Given the nature of the legal prohibitions, and the reasons for which they have been imposed, it is likely that much, if not all, of the information requested will also be covered by one or more of the other exemptions in the Freedom of Information Act. But, as indicated above, the absolute nature of a legal prohibition is likely to make it inappropriate to rely simultaneously on an exemption which requires the application of a balance of public interest. Where section 44 applies, the FOI Act has given precedence to the policy underlying the prohibition in question over the statutory rights of access. It will generally suffice to cite the prohibition in question.
