The FOI Act requires requests for information to be considered on a case by case basis. The following working assumptions will therefore not be appropriate to all situations. They are designed to highlight for officials the key factors that need to be considered in handling a request for information in the category described, and to give direction on the course most likely to be appropriate. The section on referral points draws attention to factors that may tip the balance against the usual working assumption. In these circumstances officials should seek further advice.
Officials should be aware that all unusual or particularly complex requests, not listed in the referral points, will also require consideration beyond the usual working assumption. Officials are required to make a judgement of each case on its merits.
